Membership Agreement, Waiver of Claims & House Rules
Membership Access & Check-In
Access to ZENG FITNESS is granted through our digital membership system via QR code or face recognition check-in. Your membership credentials are strictly personal and non-transferable — they admit only you. You must NOT ALLOW ANYONE ELSE TO USE YOUR MEMBERSHIP ACCESS. Report any suspected unauthorized use of your account to management immediately.
All fees paid for membership packages are NON-REFUNDABLE and NON-TRANSFERABLE under any circumstances. By availing of any membership package, you confirm that you have carefully reviewed and selected the membership plan that suits your needs.
Membership Cancellation
All membership fees are NON-REFUNDABLE. Membership may be cancelled by the Gym at any time due to violation of these Terms and Conditions, without prior notice and without refund. Members who wish to voluntarily cancel their membership must submit a written cancellation request to management. Cancellation does not entitle the member to any refund of unused membership days.
Membership Freezing & Postponement
You may request to freeze your membership due to travel abroad or medical reasons, provided you submit valid supporting documentation. Membership may be frozen for a minimum of ONE (1) MONTH to a maximum of THREE (3) MONTHS at no cost. Extension of freezing beyond three months will be charged PHP 250.00 per month. Membership freezing is applicable to 6-month and 12-month memberships only. Freezing requests must be submitted in writing to management at least one week before the intended freeze date.
Minor Membership Policy
Members below 18 years of age are considered minors. A parent or legal guardian must sign the membership agreement and all consent forms on behalf of the minor. The parent or legal guardian assumes full responsibility for the minor's conduct, safety, and compliance with these Terms and Conditions while inside the Gym premises.
Dress Code Policy
Proper athletic wear is required at all times inside the Gym premises. The following are NOT ALLOWED:
- Slippers, sandals, or open-toed shoes
- Jeans or denim of any kind
- Clothing with offensive or inappropriate prints or language
Shirts must be worn at all times inside the Gym. Management reserves the right to refuse entry to any member who does not comply with the dress code policy.
Hygiene Policy
All members are expected to maintain proper personal hygiene at all times. Members must bring and use their own personal towel. Avoid wearing excessive perfume, cologne, or strong-smelling products that may cause discomfort to other members. Members who are visibly ill or show signs of contagious conditions may be asked to leave the premises for the safety of other members.
Equipment Etiquette
Members are expected to use equipment responsibly and courteously:
- Return all weights and equipment to their proper place after use
- Wipe equipment before and after use with the provided cleaning materials
- Reserving equipment with towels, bags, or personal items while not actively using it is not allowed
- Report any damaged or malfunctioning equipment to management immediately
Cleanliness & Housekeeping
Members share responsibility in maintaining the cleanliness and orderliness of the Gym. Dispose of trash, food wrappers, and drink containers in the designated bins. Do not leave personal items unattended in common areas. Members who repeatedly leave the Gym in an untidy or disrespectful state may be subject to a warning or membership suspension at the discretion of management.
Operating Hours Compliance
The Gym operates from 6:00 AM to 12:00 MN daily. Last entry is at 11:00 PM to ensure all members have sufficient time for their workout. Members must vacate the Gym premises by 12:00 MN. Management reserves the right to adjust operating hours with prior notice. The Gym shall not be liable for any inconvenience caused by temporary changes in operating hours due to maintenance, special events, or other operational requirements.
Health Protocols & Medical Responsibility
You confirm that you are physically fit to engage in physical exercise and gym activities. You are solely responsible for consulting with your physician before starting any exercise program, particularly if you have a pre-existing medical condition. You are responsible for following all health protocols mandated by the government and implemented by ZENG FITNESS. The Gym is not responsible for any health complications arising from your use of the facilities.
CCTV & Biometric Surveillance Disclosure
ZENG FITNESS operates closed-circuit television (CCTV) cameras and a biometric face recognition check-in system within the Gym premises for security and access control purposes. All surveillance data is stored and managed in accordance with the Data Privacy Act of 2012 (RA 10173). By registering as a member and enrolling your biometric data, you acknowledge and consent to being recorded by CCTV cameras and to the collection and storage of your biometric information for access control purposes only.
Right to Refuse Entry & Membership Suspension
ZENG FITNESS reserves the right to refuse entry to any person who appears to be under the influence of alcohol, illegal drugs, or any substance that may impair judgment or physical coordination. Entry may also be refused to any person who poses a threat to the safety, comfort, or wellbeing of other members or staff. Management reserves the right to suspend or terminate any membership at its discretion if the member's behavior is deemed detrimental to the Gym's environment or reputation, with or without prior notice.
Locker Usage & Personal Belongings
Locker keys are available at the front desk and must be returned after every visit. Unreturned keys at the end of your visit will be subject to a replacement fee. ZENG FITNESS is not liable for any lost, stolen, or misplaced personal belongings. Lost and found items will be kept by management for 30 days. After 30 days, the Gym reserves the right to dispose of unclaimed items.
Guest Invitation Pass
Members are entitled to bring up to two (2) guests per month as a membership privilege. Guest visits are limited to twice per month per member. Guests must be accompanied by the member at all times. The member assumes full responsibility for the conduct and safety of their guest/s while inside the Gym premises. Guests are subject to the same rules and regulations as members.
Casual fitness advice between friends is acceptable. However, any structured, repeated, or systematic instruction — whether paid or unpaid — is considered unauthorized coaching and is strictly prohibited. Any guest found conducting unauthorized coaching will be immediately removed from the premises and the inviting member's guest privilege will be permanently revoked.
Referral Program
Members who refer a new paying member to ZENG FITNESS may be entitled to referral rewards as announced by management from time to time. Referral rewards are subject to change without prior notice and are at the sole discretion of management. Referral rewards cannot be exchanged for cash and are non-transferable.
Member Feedback Policy
ZENG FITNESS values the feedback of its members. Members may submit feedback, suggestions, or complaints to management at any time via email at zengfitnessadmin@gmail.com or through the feedback box at the Gym premises. All feedback will be reviewed within 7 business days. Anonymous feedback is accepted. Management commits to addressing all valid concerns in a fair, timely, and confidential manner.
Gym Moral Code, Conduct & Safe Space Policy
You shall not engage in any commercial or business activity while using the Gym facilities. The following acts are STRICTLY PROHIBITED and will result in IMMEDIATE AND PERMANENT MEMBERSHIP CANCELLATION without refund:
- Physical violence, threats, or intimidation against any member, guest, or staff
- Sexual harassment in any form — including unwanted physical contact, sexually suggestive remarks, catcalling, persistent unwanted attention, or any behavior that makes another member feel unsafe or uncomfortable
- Voyeurism, inappropriate staring, or any behavior intended to make another member feel watched or violated
- Taking photos or videos of other members without their explicit consent, particularly in changing areas, shower areas, or any private space
- Bullying, intimidation, discrimination, defamation, or harassment based on gender, body type, age, religion, or any personal characteristic
- Stalking or following another member inside or outside the Gym premises
- Any act that violates the Safe Spaces Act (RA 11313) of the Philippines
ZENG FITNESS reserves the right to immediately remove any member from the premises, cancel membership without prior notice and without refund, and report the incident to proper authorities. All reports will be treated with confidentiality and taken seriously.
Unauthorized Coaching & Commercial Activity
ZENG FITNESS is a GYM-ONLY facility. No coaching, training, or instruction services of any kind are permitted inside the Gym premises without the express written authorization of ZENG FITNESS management. The following are STRICTLY PROHIBITED:
- Offering, soliciting, or conducting personal training, fitness coaching, or any form of structured instruction to any member or guest — whether paid or unpaid
- Approaching, soliciting, or recruiting members for personal training services
- Distributing business cards, flyers, or any marketing materials inside the Gym premises
- Using the Gym's name, facilities, or equipment to promote personal coaching or fitness services on social media or any other platform without written consent
- Conducting group training sessions, bootcamps, or any organized fitness activity without written authorization
- Inviting or bringing an outside personal coach or fitness instructor to provide coaching services inside the Gym premises — whether paid or unpaid
Violations will result in immediate removal, permanent membership cancellation without refund, demand for damages, and legal action if necessary. This policy applies to ALL members regardless of professional background or fitness credentials.
Photography, Video & Social Media
Photography and video recording inside the Gym premises are allowed for personal use only. You must obtain the explicit consent of any person who appears in your photos or videos before posting them on any social media platform. Taking photos or videos of other members or staff without their consent is strictly prohibited. The Gym reserves the right to take photos and videos for marketing and documentation purposes with explicit member consent. Members are encouraged to tag ZENG FITNESS in their workout posts on social media.
Personal Information & Data Privacy
You confirm that all personal information you have provided is accurate and verified at the time of registration. You agree to notify ZENG FITNESS in writing at least one week in advance of any changes to your personal information. Your personal information will be collected, stored, and used solely by ZENG FITNESS for membership management purposes, in compliance with the Data Privacy Act of 2012 (RA 10173). Your information will not be sold or shared with third parties without your consent.
Force Majeure
The Gym shall not be held liable for any failure or delay in providing services due to circumstances beyond its reasonable control, including but not limited to natural disasters, calamities, government-mandated lockdowns, pandemics, fire, power outages, or other force majeure events. In such cases, the Gym will make reasonable efforts to extend membership validity accordingly, at its sole discretion.
Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to this agreement shall first be subject to good faith negotiation between the member and ZENG FITNESS management. If the dispute cannot be resolved amicably within 30 days, it shall be submitted to the appropriate courts of the Philippines. This agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
Amendments to Terms & Conditions
ZENG FITNESS reserves the right to amend, update, or modify these Terms and Conditions at any time. Members will be notified of any significant changes via email or posted notice at the Gym premises. Continued use of the Gym after such notification constitutes acceptance of the updated Terms and Conditions.
Assumption of Risk & Waiver of Claims
I acknowledge that ZENG FITNESS is a fitness facility and that there is inherent danger connected with any physical activity, including the dangers of physical injury and death. I voluntarily assume all risks associated with the use of the Gym facilities and equipment.
I assume all the risks and waive all rights to pursue money damages or any other relief of any kind, arising from my entry into or use of ZENG FITNESS facilities, on behalf of myself, my heirs, executors, administrators, and assigns. I agree to indemnify and hold harmless ZENG FITNESS, its owner/s, employees, agents, successors, and assigns, from and against any loss or damage that may be sustained by me or any person entering the Gym as my guest.
Communication Consent
I consent to receive personalized SMS and email communications from ZENG FITNESS regarding my membership, gym updates, promotions, and other relevant communications. I understand that my personal information will be used solely by ZENG FITNESS and will not be sold or shared with third parties. I may opt-out of communications at any time by emailing zengfitnessadmin@gmail.com.
ACKNOWLEDGMENT
I hereby confirm that I am aware of and agree to all the Terms and Conditions, Assumption of Risk, Waiver of Claims, and Communication Consent of ZENG FITNESS as stated above. My digital signature, QR code registration, or biometric enrollment constitutes full acceptance of this agreement.
